This Privacy Policy explains how ACP Equities, LLC ("ACP", "we", "us") collects, uses and shares personal data when you use our websites, console, APIs and A2P SMS services (the "Services"). It applies to our customers, their authorized users, visitors to our websites, and — to the extent we process them on behalf of customers — recipients of messages sent through the platform.
1. Data we collect
Account data: name, company, email address, mobile phone number, password hash, billing details. Usage data: API calls, console activity, IP addresses, device and log information. Messaging data: recipient numbers, sender identifiers, message content, routing metadata and delivery receipts, processed on behalf of the sending customer. Support data: correspondence with our support mailbox.
2. How we use data
We use data to provide and operate the Services (routing, delivering and evidencing messages), to secure the platform (fraud, spam and abuse prevention), to bill and settle usage, to provide support, to comply with legal and carrier obligations, and — with your consent where required — to send service and marketing communications.
3. SMS consent and opt-out
When you register with a mobile number and tick the SMS consent box, you agree to receive account-related SMS from ACP (such as verification codes and critical service alerts). Message frequency varies; message and data rates may apply. Reply STOP to opt out at any time and HELP for assistance; opting out of verification messages may limit account features. Consent to receive SMS is not a condition of purchasing any other service.
4. Sharing
We share data with mobile carriers, interconnect partners and registries as necessary to route and deliver messages and complete required registrations; with service providers (hosting, analytics, payments) under contract; with authorities where required by law; and in connection with a corporate transaction. We do not sell personal data, and we do not share mobile numbers obtained for SMS consent with third parties for their own marketing.
5. Retention
Account data is retained for the life of the account and as required thereafter for legal and accounting purposes. Message content is retained transiently for routing and troubleshooting and then deleted or anonymized; delivery metadata and CDRs are retained for up to 13 months for billing, audit and quality measurement, unless a longer period is required by law.
6. Security
We apply industry-standard safeguards: encryption in transit, hashed credentials, network isolation, least-privilege access and audit logging. No system is perfectly secure; we notify affected parties of incidents as required by applicable law.
7. International transfers
Routing messages globally requires transferring data across borders. Where we transfer personal data from jurisdictions that restrict transfers, we rely on appropriate safeguards such as standard contractual clauses.
8. Your rights
Depending on your jurisdiction, you may have rights to access, correct, delete, restrict or port your personal data, and to object to certain processing. EU/UK residents may lodge complaints with their supervisory authority; California residents have rights under the CCPA/CPRA, including the right not to be discriminated against for exercising them. 9. Cookies
Our websites use strictly necessary cookies for authentication and session management, and privacy-respecting analytics to understand aggregate usage. We do not run third-party advertising trackers.
10. Children
The Services are not directed to individuals under 18, and we do not knowingly collect personal data from them.
11. Changes to this policy
We may update this policy from time to time. We will post the revised version here with an updated date and notify account holders of material changes.
